1. Acceptance of Terms
By accessing or using JobsinCebu, you acknowledge and agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations of the Republic of the Philippines. If you do not agree, you must refrain from using the platform.
JobsinCebu operates solely as a digital intermediary and does not participate in, endorse, or guarantee any employment arrangement, transaction, or communication between users. Use of the platform is at your own risk.
2. User Eligibility
- You must be at least 18 years old or of legal working age in the Philippines.
- Employers must be duly registered entities with valid business permits and tax identification numbers.
- By registering, users warrant that all information provided is accurate, lawful, and complete.
3. Data Privacy and Protection
JobsinCebu is committed to protecting personal data in accordance with the Data Privacy Act of 2012.
- Personal information is collected solely for job matching, recruitment, and platform improvement.
- Users may access, correct, or delete their personal data at any time via account settings.
- Reasonable and appropriate security measures are implemented to prevent unauthorized access, disclosure, or misuse.
- JobsinCebu does not sell or share personal data with third parties without explicit consent, except as required by law.
4. User Responsibilities
Job Seekers:
- Provide truthful, lawful, and up-to-date information.
- Do not impersonate others or submit misleading credentials.
Employers:
- Post legitimate job opportunities in compliance with Philippine labor laws.
- Ensure job descriptions, compensation, and benefits are accurate and non-discriminatory.
- Avoid collecting sensitive personal data unless necessary and with informed consent.
5. Prohibited Conduct
Users must not:
- Use the platform for unlawful, fraudulent, or harmful purposes.
- Post content that is defamatory, obscene, discriminatory, or infringes intellectual property rights.
- Attempt to breach platform security or access other users’ data.
JobsinCebu reserves the right to suspend or terminate accounts that violate these terms.
6. Content Ownership and Licensing
- Users retain ownership of uploaded content (e.g., resumes, job posts).
- By submitting content, users grant JobsinCebu a non-exclusive, royalty-free license to use, display, and distribute such content for platform-related purposes.
7. Limitation of Liability
JobsinCebu shall not be held liable for:
- Employment outcomes, hiring decisions, or user conduct.
- Third-party content, links, or external services.
- Temporary service interruptions, data loss, or technical errors.
- Any direct, indirect, incidental, or consequential damages arising from platform use.
JobsinCebu disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
8. Platform Modifications
JobsinCebu may modify, suspend, or discontinue any part of the platform at any time, with or without notice. Continued use constitutes acceptance of such changes.
9. Notifications and Communication
- Users agree to receive platform-related communications via email, SMS, or in-app notifications.
- Marketing communications may be opted out of at any time.
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Republic of the Philippines.
- Disputes shall be resolved first through amicable negotiation.
- If unresolved, disputes shall be submitted to arbitration or the courts of competent jurisdiction in Cebu City.
- Users waive any right to bring class actions or claims against JobsinCebu in jurisdictions outside the Philippines.
11. Fraud Disclaimer and Due Diligence
JobsinCebu is a neutral platform and does not verify, endorse, or guarantee the legitimacy, accuracy, or conduct of any user, job post, or employer.
- Users are solely responsible for conducting their own due diligence, including background checks, identity verification, and validation of job offers or applicant credentials.
- JobsinCebu shall not be held liable for any fraudulent, misleading, negligent, or unlawful activity committed by users, employers, or third parties.
- We strongly encourage all parties to exercise caution, report suspicious behaviour, and consult appropriate legal or regulatory authorities when necessary.
12. Indemnity
By using JobsinCebu, you agree to indemnify, defend, and hold harmless JobsinCebu, its owners, affiliates, officers, and employees from any claims, liabilities, damages, losses, or expenses—including legal fees—arising from your use of the platform, violation of these Terms, or infringement of any rights.
